Terms and Conditions

Thank you for your interest in H and S Auto Sales. Our hours of operation are Monday – Friday 8:30 a.m. to 5:00 p.m. (EST) and we are closed on Saturday and Sunday.
H and S Auto Sales Fees:
Registration fee: -0-
Security Deposit: Minimum of $400.00 for 1 car
Transaction fee: Greatest of $275.00 or 5% of the vehicle sale price on each vehicle purchased from H and S Auto Sales.
SECURITY DEPOSIT:
In order to complete the registration process you must submit a security deposit through Paypal. A $400.00 security deposit secures a $4000.00 bid limit and allows you to bid on 1 car. Your bidding amount can be increase higher than $4000.00 by submitting an additional security deposit in the amount of 10% of the total dollar amount you would like to bid. Car limits can be increased as well with an additional security deposit. All additional security deposits must be submitted through Paypal by sending money to wfhancock@yahoo.com. To inquire about any limit increases please contact Kelly at 434-432-0070. YOUR ACCOUNT WITH US WILL BE SUSPENDED IF THESE GUIDELINES ARE NOT FOLLOWED AND YOUR SECURITY DEPOSIT WILL BE HELD UNTIL ALL BIDS ARE CLEARED. THERE WILL BE NO EXCEPTIONS.
BIDDER NUMBER AND PASSWORDS
To get started with H and S Auto Sales broker program please visit our website handsautosales.com and click on register to bid in the top right corner of your screen. Once all required information is completed on our registration page and your security deposit is received you will be issued and bidder number and password that will be emailed to you in two separate emails. Use the H and S Auto Sales issued bidder number and password to login on www.copart.com If you do not receive this information within 1 hour of registering please contact us via email at wfhancock@yahoo.com. If you have any questions regarding registration or any other information about the program please contact Kelly at 434-432-0070 or at our email address wfhancock@yahoo.com.
Buyers:
Buyers agree and acknowledge that they are purchasing from H and S Auto Sales and not from Copart.
PLACING A BID
Once a bid has been submitted, it cannot be retracted, deleted, or cancelled. ***ALL VEHICLES ARE SOLD AS IS, WHERE IS. NO WARRANTIES WRITTEN, IMPLIED, OR OTHERWISE.***
WINNING BIDS AND INVOICES
If a bidder wins an auction H and S Auto Sales will receive email notification from Copart. Once email conformation is received an invoice containing the total amount due for the vehicle (Sales price, Copart fees, and H and S Auto Sales transaction fee) will be emailed to your email address. Wire transfer instructions will be attached.
PAYMENT FOR VEHICLES
It is the responsibility of the bidder to wire the total amount due from their bank account to H and S Auto Sales bank account within 24 hours of winning the auction. PAYMENTS FOR VEHICLES ARE MADE BY BANK TO BANK WIRE TRANSFER ONLY. Once payment is posted in our bank account we will make payment to Copart for your vehicle.
***SECURITY DEPOSITS ARE NOT USED TO PAY FOR VEHICLES IN ANY SITUATION.***

Internet Bid Fee
Copart offers bidding kiosks in the lobbies of all of its facilities. These kiosks can be used to place preliminary bids on vehicles located at that particular yard. If a winning bid was placed on a vehicle using a kiosk located at that yard, no internet fees are assessed against that vehicle. If the winning high bid was placed during Preliminary Bidding via the internet or during the live,
virtual auction, Copart charges an Internet Bid Fee to the high bidder. The fee is based upon the high bid amount: a fee of $35.00 for sale prices from $1.00 up to $999.99, a fee of $50.00 for sale prices from $1,000.00 - $1,999.99, a fee of $75.00 for sale prices of $2,000.00 or higher.
Gate Fee
A $30.00 Gate/Loading Fee is assessed to all vehicles. This fee covers the movement of the vehicle from Copart’s sale/storage facilities to the buyer’s loading area. For buyers whom are picking up the vehicle with vehicle transporters, this fee covers the time and manpower required to assist the driver in loading the vehicle onto the truck. Drivers are 100% responsible for securing their load at all times.
LATE FEES
If payment is not received within 24 hours of winning an auction a $50.00 late fee will be charged. This fee is payable by the bidder.
RELIST FEES
If the buyer is awarded the bid and does not complete the transaction for any reason, the bidder will forfeit their security deposit in the amount of the relist fee. Copart’s relist fee is a minimum of $400.00 or 10% of the vehicle sale price, whichever is greater. It is the responsibility of the bidder to pay any relist fees.
STORAGE FEES
At the time you win an auction you have 6 days to pick up a vehicle from the Copart yard. ***DO NOT ARRANGE FOR TRANSPORT OF THE VEHICLE UNTIL YOU RECEIVE EMAIL NOTIFACTION FROM H AND S AUTO SALES THAT PAYMENT HAS BEEN MADE.*** On the 7th day the bidder will start being charged a $20.00/day storage fee.
***THE BIDDER’S ACCOUNT WILL BE SUSPENDED UNTIL ALL FEES ARE PAID IN FULL.***
TITLES
H and S Auto Sales will issue a buyer order, vehicle reassignment, and title or certificate for each vehicle that is sold. You must be 18 years old to purchase a vehicle. Vehicles must be paid for and all fees paid before your title will be mailed. The bidder must provide a faxed copy of a valid driver’s license. INFORMATION OBTAINED DURING REGISTRATION WILL BE USED TO COMPLETE ALL PAPERWORK FOR VEHICLES PURCHASED.
DAMAGES AND KEYES
H and S Auto Sales is not responsible for any vehicle damage or loss of keys.
VISITS TO THE COPART YARD
$25.00 per person payable at the Copart yard. Bidders must provide their bidder number upon arriving at the Copart yard. Contact the Copart facility for the preview days/hours.
***Bidders agree to be bound by the terms and conditions of H and S Auto Sales and acknowlege that H and S Auto Sales reserves the right to amend these terms and conditions at any time without prior notices to registered bidders.
COMPLIANCE
Bidders shall comply with all applicable laws, statutes, ordinances, and regulations, regarding their use of H and S Auto Sales broker services.
REGISTRATION LAWS DISCLAIMER
H and S Auto Sales does not guarantee that any vehicle sold can be legally registered in any state or country. The bidder accepts all risks associated with variations in vehicle title and registration laws between states, provinces, and countries that may negatively impact the marketability of vehicles purchased from H and S Auto Sales broker services.
LITIGATION
Any legal action or proceedings arising out of a vehicle purchased from H and S Auto Sales shall be litigated only in the state/province and country where the vehicle was stored at the time of sales.
This agreement is the entire and sole agreement of the parties here with respect to its subject matter. There have been no representations, warranties, or promises outside of the H and S Auto Sales terms and conditions.
